温观明老前辈昨晚申诉身体不适后昏迷送院。院方查诊后得知他中风了,脑溢血,昨晚昏迷至今未醒,仍在ICU

颜贝倪欣慰武吉公满上诉获准, 促各地区反公害运动互相支援

人民公正党妇女组全国副主席颜贝倪对于联邦法院批准武吉公满村民的准令,表示欣慰。

也是万挠区州议员的颜贝倪强调,目前同时正在反高压电缆的万挠居民、反山埃的武吉公满村民和反莱纳稀土厂的关丹人民都是进行伟大的公民教育运动,更应该加强联系,互相支援。

“许多年前的家长一家大小出来捍卫社区的权利、保护美丽的家园主要是为了下一代有个健康的环境,也不希望美丽的家园最后因为辐射消失。”

“国家在迈向发展的同时,必须以人民的安全与健康为重。因此,我呼吁大家继续支持我们这些反对公害的人士们,壮大人民力量!”

村民不屈不挠终见曙光

颜贝倪表示,自2008年武吉公满村民成立“反山埃采金工委会”入禀法庭,申请司法检讨环境局允许金矿公司以上埃采金的决定在2009年被高庭驳回后,工委会没有放弃斗争并再次向上诉庭申请。

2011年,上诉庭又驳回村民针对武吉公满金矿公司的司法审核申请,然而工委会并没有灰心,在于广大的村民商讨后,决定入禀联邦法院以申请推上诉庭裁决。

“经过村民4年来不曾放弃的精神后,联邦法庭法官发出上诉准令的判决,终于让武吉公满村民对于多年反山埃采金运动看到曙光。”

“虽然接下来上诉的过程有可能很漫长,但是只要有村民们继续团结一致,坚持到底一定可以在斗争的道路获取胜利。”

慕斯达法抱病出席交流

颜贝倪对反山埃委员会秘书慕斯达化无法见证这喜讯就离开人间而表示遗憾,并向慕斯达化家人致哀。

“我曾经两次拜访劳勿武吉公满村并于反山埃委员会及村民交流时,慕斯达化都是抱病出席交流会,他对反山埃不屈不挠的精神是让人敬佩的。 ”

“抗山埃保家园”的第一线曙光

Melangkah tahun ke-4, " Membantah Cyanide, Mempertahankan Kampung Halaman" akhirnya memperoleh kemenangan peringkat pertama.
Pada 11hb,Makhamah Persekutuan telah mengizinkan rayuan penduduk Bukit Koman agar mencabar Jabatan Alam Sekitar yang mengesahkan Syarikat Raub Australian Mining dalam operasi perlombongan emas dengan penggunaan Cyanide. Meskipun tidak tahu akan keputusannya, namun peluang rayuan ini pasti telah menjanjikan sedikit harapan yang positif.

Namun, salah seorang wira penentang Cyanide kita, En Mustapha tidak sempat mendengar berita yang baik ini. Beliau telah meninggal dunia sehari sebelum keputusan makahmah diumumkan. Hal ini amat menyedihkan lantaran beliau merupakan wira kedua kita yang meningggalkan kita, selepas bendahari kita En. Chong Sao Ping yang turut telah meninggal dunia pada tahun 2008.

Penduduk kampung merayu agar pertimbangan semula dibuat terhadap keputusan Jabatan Alam Sekitar tentang kebenaran penggunaan cyanide dalam perlombongan emas.
Di samping itu, keputusan pengarah Jabatan Alam Sekitar yang mengesahkan Laporan Penilaian Pencemaran Alam Sekitar yang dikemukakan 14 tahun yang lalu dapat dibatalkan. 
Demi mempertahankan hak kita, pelbagai usaha telah dilakukan oleh penduduk, walau bagaimanapun harapan penduduk masih tidak tercapai sebaliknya sering menghadapi berbagai-bagai halangan dari banyak pihak.

Wira-wira pelindung kampung halaman kita sewajarnya menikmati
kebahagian keluarga lantaran majoriti mereka telah menjangkau unmur tua seperti En. Musthapa. Beliau masih bolak-balik ke sana dan ke sini demi mempertahankan kampung halaman kita meskipun beliau yang pernah diserangi penyakit strok.
 Apakah mesej di belakang? Benarkah kita mempolitikkan isu ini? Ataupun kami yang dipolitikkan? Di manakah kesedaran moral terhadap kebajikan rakyat?
 
武吉公滿“抗山埃,保家園”運動邁入第4年,終于在日前取得第一階段的勝利。


 
聯邦法院在11日批准村民針對無法取得准令,以挑戰環境局總監認可勞勿澳洲金礦私人有限公司使用山埃(氰化物)進行采金的決定提出上訴。雖然上訴過程將是另一個未知的挑戰,可是能夠上訴,畢竟還保有一線希望。

 
然而,本該為此感到振奮的武吉公滿村民,卻在欣慰中夾雜著哀愁。就在聯邦法院下判的前一個晚上,村民再度失去另一個親密戰友。反對山埃采金委員會的秘書──慕斯達化先生來不及聆聽這個重要的宣判,先一步離開人世了。另一位已逝的反山埃先驅,為2008年離世的財政張少平先生


 
2008年,武吉公滿村民正是在慕斯達化先生、張少平先生,以及另外兩位分別擔任反對山埃采金委員會主席及副秘書的黃金雄先生及邱惠豪先生帶領下,入稟高庭要求針對有關采金計劃進行司法審核。

村民要求檢討環境局總監批准有關采金計劃的決定,以及撤消環境局總監14年前批准金礦公司所提呈的環境影響評估報告,並在有關金礦公司重新提呈一份新的詳細環境影響評估報告前暫停運作


 
有關要求卻先后在2009年及2011年,被高庭及上訴庭以“太遲提出申請”的技術理由駁回,不少村民聞訊后還黯然落淚。

 
可是,村民還是從一輪又一輪的司法挫敗、一次又一次被政黨人士的冷嘲熱諷中挺了過來,不是因為他們特別堅強,而是因為家園是他們最后的堡壘,他們已經無路可退。

 
也正因為這個信念,讓早前中風后的慕斯達化為了“抗山埃,保家園”,還是堅持撑著枴杖上下奔波。


 
這群本該坐在家裡享兒孫福的老人家,何故還要一肩扛起這個困難重重的鬥爭,甚至到了臨終的一刻,還是對此念念不忘?這當中的原因,真的可以一句“政治化”就可以輕輕帶過,劃過良心不著痕跡?

BERNAMA:Federal Court Grants Leave To Appeal To Bukit Koman Residents

PUTRAJAYA, Jan 11 (Bernama) -- Villagers of Kampung Bukit Koman in Raub who claim to have suffered health problems from the use of cyanide in a gold mine in the vicinty, can continue on with their legal struggle for a pollution- free environment.

This follows a decision by a three-man Federal Court panel chaired by Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum to allow the residents' application for leave to appeal against a High Court's refusal to grant them permission to commence a judicial review.

They failed in their bid to obtain leave from the High Court on June 1 2009 to file a judicial review proceeding to challenge the Environment Director-General's decision to approve a preliminary environmental impact assessment (PEIA) report concerning the Bukit Koman gold mine which is located nearby their village.

Malanjum, who sat on the panel with Federal Court judges Tan Sri Abdull Hamid Embong and Datuk Ahmad Maarop, gave the nod on one legal question to be determined by the Federal Court.

The question of law was whether a court, in determining an application for extension of time to file a leave application, is required to consider the merits of the applicants' complaint set out in their leave application to commence a judicial review.

The High Court threw out the residents' leave application for a judicial review on grounds that there was an inordinate delay by them in filing the application and that they did not have good reasons for the court to grant an extension of time for them to file their application.

Order 53 Rule 6 of the Rules of the High Court 1980 provides that an application for leave for judicial review shall be made prompty and in any event within 40 days from the date when the grounds of the application first arose or when the decision was first communicated to the applicant.

The appellate court accepted the findings of the High Court and dismissed the residents' appeal on Aug 3 last year.

Outside the court, their lawyer Malik Imtiaz Sarwar said both the High Court and appellate court had held that the court would only look at the reasons for the delay in filing the application and not the merits of the complaint which precluded the public interest dimension.

The Environment Director-General approved the PEIA report on Jan 13, 1997. Via a letter dated Feb 21, 2008, the DG declined to acceed to the residents' request to review the PEIA and require Raub Australian Gold Mining Sdn Bhd (RAGMSB) to provide a detailed one.

On March 21, 2008, four representatives of the residents, Wong Kin Hoong, Chong Sow Pin, Hue Fui How and Mustapha Hussin (Mustapha passed away last night), filed leave to initiate a judicial review proceeding naming the Environment Director-General and RAGMSB.

The residents want the Environment DG to require RAGMSB to furnish a detailed EIA report as they claimed the preliminary EIA (PEIA) report submitted by the gold mining company on Aug 27, 1996 contained serious deficiencies.

They claimed the PEIA report omitted information on where and how treatment of gold mining waste should be disposed off, and also contained inadequate information on discharge of effluents.

The residents also alleged the PEIA report infringed on their fundamental rights to life and livelihood due to its omission on the facility's risks to public health and environment.

They also claimed that the PEIA preparation did not include public participation.

In their affidavit affirmed on May 12, 2009, the applicants alleged that in early February 2009, they encountered strong and noxious fumes several times a day, causing them to choke, suffer giddiness, shortness of breath, irritation to the eyes and lungs, nausea and body rashes.

Senior Federal Counsels Suzana Atan and Suhaila Haron represented the Enviroment Director-General while RAGMSB was represented by a team of lawyers led by Tan Sri Cecil Abraham.

村民挑战环境局决定,反山埃采金获准上诉!




(布城11日訊)彭亨勞勿武吉公滿新村村民經過長時間爭取後,聯邦法院終批准村民針對無法取得准令,以挑戰環境局總監認可澳洲金礦私人有限公司使用山埃(氰化物)進行採金計劃的決定提出上訴,讓村民多年來的反山埃採金法律鬥爭,得以看到一線希望。

以沙巴及砂拉越大法官馬拉尊為首的聯邦法院三司一致發出上訴准令給村民,以便他們針對無法挑戰環境局總監接受澳洲金礦公司在使用山埃採金活動中提呈的初步環境影響評估報告的決定提出上訴。

約30名穿著“抗山埃,保家園”T恤的村民,週三從勞勿到布城司法宮聆聽判決後,感到非常興奮。

聯邦法院將在日後擇訂日期聆審村民的正式上訴。

此外,聯邦法院三司在批准村民的上訴令申請時,只允許他們在日後的上訴案中提出一項法律問題,以讓聯邦法院作出鑑定,其餘4項法律問題則加以拒絕。

馬力英迪亞律師較後在庭外說,這是村民法律鬥爭的第一階段勝利。

“這是第一階段勝利,如果聯邦法院週三沒有發出上訴准令,那意味著我們完全輸了,現在起碼大門還開著,接下來是進入第二階段的正式上訴爭論。”

他說,日後聯邦法院的上訴階段,若聯邦法院的判決對他們有利,或會出現兩個情況,即聯邦法院直接發出准令以讓村民到高庭申請司法審核環境局總監的決定,或聯邦法院要求高庭聆審村民的司法審核准令申請。

“不過,我將以公眾利益及節省時間的理由,要求聯邦法院直接發出准令以讓村民提出司法審核申請。”

他補充,前面還有漫長的鬥爭之途。

將定奪是否允准延時申請入稟

聯邦法院在日後聆審此上訴案時,將會對勞勿武吉公滿新村村民在要求延長時間入稟司法審核准令申請時,法庭是否需考慮村民對健康、生活及環境等的投訴,作出決定。

高庭是於2009年6月1日以村民已超出法律所規定的40天期限,即延遲11年後才提出司法審 核申請,同時未擁有良好理由以便法庭批准他們申請延長時間提出申請,因此,高庭拒絕發出准令讓他們挑戰環境局的決定。高庭也認為,環境局總監於2008年 2月21日回信拒絕村民要求更詳細環境影響評估報告並不是一項更可被檢討的裁決。.上訴庭於去年8月3日駁回村民的上訴,維持高庭的判決,他們週三再向聯 邦法院申請准令以提出上訴。

代表村民的馬力英迪亞律師週三在陳詞時說,高庭及上訴庭在駁回村民的准令申請時,拒絕考慮村民的投訴而只考慮村民延遲的理由,並認為村民未具良好理由以允准他們延長時間,提出司法審核申請是錯誤的。

“高庭及上訴庭應考慮村民對健康及環境的投訴,允准他們延長時間申請司法審核環境局總監的決定。”

入稟要求審核山埃採金

以武吉公滿新村反山埃委員會主席黃金雄為首的4名成員,是於2008年3月21日入稟高庭,要求高庭允准他們針對環境局總監及澳洲金礦公司有關涉及使用稀釋的氰化物(山埃)來進行碳漿法(Carbon-In-Leach)採金計劃提出司法審核申請。

不過,其中一名申請人慕斯達化已於週二晚病逝,另一名成員張少平更早之前就已病逝。

武吉公滿新村約有3000名居民,周遭居民則有1萬人。

反山埃委會秘書病逝

勞勿武吉公滿反山埃委員會秘書慕斯達化週二在淡馬魯蘇丹阿末沙醫院病逝,反山埃委員會成員因為趕去布城聯邦法院聆聽起訴勞勿澳洲金礦公司的最後判決,無法送他最後一程。

64歲的慕斯達化患有糖尿病、高血壓和腎病。他中風後曾接受針灸並逐漸康復,能拄拐杖及開車出外。去年11月7日病發昏迷不醒,病情一直不樂觀。

委會成員趕不及出席

拖了近兩個月,週二晚11時許,反山埃委員會成員接到消息,指慕斯達化死於多重器官失去功能,包括腎衰竭,遺體週三運回家鄉勞勿安葬。

反山埃委員會成員週三凌晨5時,共乘巴士到布城聯邦法院聽審,因此無法出席慕斯達化的葬禮。

反山埃委員會透露,慕斯達化中風拄枴杖行走時曾說“就算我不能行走,我用爬的,也要爬出來向山埃採金抗戰到底”。他還有一句名言:“我們今天選擇站出來,是因為我們不想日後子子孫孫責問我們,當初為何沒有盡力去保護他們”。

武吉公滿反山埃委員會主席黃金雄說,慕斯達化與反山埃戰友共同為拒絕山埃採金奮鬥多年,週二傳出病逝消息,大家都好傷心。“他的離開,對我們來說是沉重的打擊。”

儘管無法趕回出席慕斯達化的葬禮,黃金雄已經托人前往喪府慰問。

上訴庭在去年8月3日駁回村民針對武吉公滿金礦公司的司法審核申請,然而武吉公滿反山埃委員並沒有灰心,在與廣大村民商討後,決定入稟聯邦法院起訴勞勿澳洲金礦公司。聯邦法院週二作出最後判決。(光明日報)
